These Event Safety and Liability Terms apply to every event operated by Riverside Fairways, LLC. They describe how we keep play safe, what we need from the person booking the event, and how responsibility is allocated.
Please share these terms with your venue contact and with anyone helping to run your event.
This Is Not a Substitute for a Signed Waiver
These terms explain our expectations and are part of the agreement for your event. They do not replace any separate liability waiver, assumption of risk form, or venue paperwork we may ask participants or the host to sign before play begins. Where a signed waiver or event agreement exists, that document controls.
Assumption of Risk
Golf involves swinging a club at speed. Even in a simulator, and even indoors, that carries real risk. Participation may involve the risk of:
- Being struck by a club, a ball, or a rebounding ball
- Slips, trips, or falls on the hitting surface or around equipment
- Muscle strain or other injury from swinging, twisting, or overexertion
- Contact with screens, netting, frames, mats, cabling, or projectors
- Discomfort from sound, lighting, or on-screen motion
By participating, each guest accepts these inherent risks. Guests who are pregnant, have a heart condition, a back or joint injury, a recent surgery, a seizure disorder triggered by light or motion, or any other condition affected by physical activity should not participate without checking with their own physician.
Swing Area and Safety Rules
Our team sets a designated hitting area at every event, and these rules apply throughout:
- Only one person swings at a time
- Everyone else stays behind the marked line or outside the hitting area
- No one walks in front of, beside, or across the hitting area while a club is in hand
- Only the clubs and balls we provide, or clubs we have approved, may be used
- Closed-toe shoes are strongly recommended; no bare feet on the hitting mat
- No hanging on, leaning against, pushing, or climbing the screen, netting, or frame
- Follow the directions of our on-site team at all times
Our team may pause or stop play at any time when these rules are not being followed. Repeated or serious violations may end play for the remainder of the event without refund.
Supervision of Minors
Our Feral package is built for kids’ parties, and we love running them. Safe play with children depends on adult supervision.
- Children must be supervised by a parent, guardian, or a responsible adult designated by the host at all times
- The host is responsible for arranging adequate adult supervision for the number of children attending
- Our team operates the simulator and guides play; our team does not provide childcare or general supervision
- Younger children may need an adult within arm’s reach while swinging
- We may set turn-taking rules, adjust club selection, or limit the number of children in the hitting area
Alcohol
We are glad to be part of celebrations where alcohol is served, and we ask hosts to think about the combination of drinking and swinging a golf club.
- Serving, licensing, and compliance with alcohol laws are the responsibility of the host and the venue, not Riverside Fairways
- We do not serve or supply alcohol
- Our team may decline to let a guest swing where intoxication creates a risk of injury or damage, and that decision is final
Host Responsibilities
The person or organization booking the event agrees to:
- Provide a safe, suitable setup space meeting the power, floor space, ceiling height, surface, and access requirements we have given you
- Provide safe and adequate electrical supply, and adequate cover for outdoor events
- Secure any venue permission, permit, or certificate of insurance required in advance
- Keep the setup and hitting area clear of hazards, foot traffic, and unattended children
- Arrange adequate adult supervision for any minors attending
- Communicate these safety rules to guests
- Provide a point of contact who is present and reachable during the event
Equipment Care and Damage
Our simulator, screen, netting, mats, projector, sensors, clubs, and related gear remain our property throughout the event.
- Only our team moves, adjusts, powers, or disassembles the equipment
- The host is responsible for damage caused by guests through misuse, willful damage, or failure to follow the safety rules or our team’s instructions
- The host is responsible for damage caused by venue conditions that were not disclosed to us, such as unsafe power, water intrusion, or an unstable surface
- Normal wear and tear from ordinary play is on us, not on you
Medical Emergencies
In the event of an injury or medical emergency, our team will stop play and contact emergency services if needed. The host is responsible for knowing the venue’s emergency procedures and access points. Guests are responsible for their own medical needs, insurance, and any resulting costs.
Right to Pause or End an Event
We may pause, shorten, or end an event where we reasonably believe there is a risk to the safety of guests, our team, or our equipment. That includes unsafe weather, unsafe electrical supply, unsafe venue conditions, unsafe or aggressive guest conduct, or refusal to follow the safety rules.
Where we end an event because the safety rules or agreed conditions were not met, refunds are handled under our Booking and Cancellation Policy.
Limitation of Liability
To the fullest extent permitted by law, Riverside Fairways and its owners, members, employees, and contractors are not liable for injury, loss, or damage arising from participation in simulator play, except to the extent caused by our gross negligence or willful misconduct.
We are not responsible for the condition, safety, or policies of any venue we do not own or control, for the acts or omissions of other vendors, or for guests’ personal property brought to the event.
To the fullest extent permitted by law, our total liability arising out of or relating to an event will not exceed the total amount paid to us for that event.
Indemnification
The host agrees to indemnify and hold harmless Riverside Fairways and its owners, members, employees, and contractors from claims, damages, losses, liabilities, and expenses, including reasonable attorney fees, arising out of the event, the acts or omissions of guests, or the host’s failure to meet the responsibilities described in these terms, except to the extent caused by our gross negligence or willful misconduct.
Photography at Events
We may take photos or short video clips for our portfolio and social media. If you would prefer we not photograph or record your event, tell us in advance and we will not. See our Privacy Policy for more detail, including how to request removal of an image already published.
Governing Law
These terms are governed by the laws of the State of Louisiana, without regard to its conflict of law principles.
